Even though a new divorce suit has been filed, Venna Melinda and Ferry Irawan's current marriage status is still valid in the eyes of the law.

Brilio.net - Venna Melinda has stepped back into the legal realm by filing for divorce against her husband, Ferry Irawan. This step is a follow-up to Venna's previously delayed decision.

Venna's attorney, Emi Wiranto, stated that the divorce suit was filed after the previous legal process was deemed to have lapsed. Emi explained that Venna did not attend in person to register her divorce suit, but through her attorney at the South Jakarta Religious Court.

"Today we come as Venna Melinda's legal counsel to file for divorce from Ferry Irawan. Because 6 months have passed, it is legally void," said Emi Wiranto, Venna Melinda's legal team at the South Jakarta Religious Court, quoted by brilio.net from KapanLagi, on Wednesday (4/9).

The previous legal process had brought Venna and Ferry to the divorce trial stage which had even been decided by the Panel of Judges of the South Jakarta Religious Court. However, the decision did not result in an official divorce due to problems in the talak vow.

According to Wijayono Hadisukrisno, Venna's other attorney, Ferry did not carry out the divorce vow, so their marriage status returned to its original state. Not wanting to repeat the same mistake, Venna this time decided to be the party filing for divorce.

"It is true that the divorce has been broken off, it should have been followed up with a vow of divorce. However, the vow has not been carried out until now. The regulation of the law is that if the decision is not carried out for 6 months, it will automatically be cancelled," explained Wijayono.

Venna's decision to file for divorce was not accompanied by demands for property or other requests. Venna only focused on one goal, which was to end the marriage amicably. Emi also emphasized that Venna was no longer communicating with Ferry and hoped that the divorce could be resolved soon.

"There was no communication, basically everyone wanted to separate on good terms," he said.

The South Jakarta Religious Court confirmed that the divorce case filed on August 3, 2023 was considered dismissed because Ferry did not attend the divorce hearing scheduled for November 30, 2023.

This absence caused the legal process to be delayed and was finally declared void after six months of no submission of vows. According to Taslimah, Public Relations of the South Jakarta Religious Court, Venna and Ferry's marriage status returned to its original state, namely legally as husband and wife, because there was no follow-up in the six-month period.

"If the person concerned does not submit a pledge within the 6-month period, it will end on May 30, 2024," explained Taslimah.

This makes Venna have to file for divorce again if she wants to end their marriage legally. In this situation, Venna Melinda faces a legal challenge that is not easy.

Although the previous divorce proceedings had been decided, her marital status had not officially changed. Now, with the new divorce suit filed, the legal process to dissolve her marriage with Ferry Irawan will resume.

Venna hopes that this time the divorce process can be completed smoothly without any obstacles like before. The South Jakarta Religious Court also emphasized the importance of following legal procedures properly to avoid confusion or problems later on.

Failure to carry out the talak vow within the specified time period can cause the marriage status to remain valid, even though the divorce trial has been carried out. Venna and Ferry must now face the legal process again to reach the desired decision.
