Brilio.net - The aftermath of the problem of Tsania Marwa and ex-husband Atalarik Syach regarding custody has reached its end. Because the Constitutional Court (MK) has granted Article 330 of the Criminal Code to criminalize parents who do not hold custody who take children by force. Regarding this matter, Tsania firmly will not put her ex-husband in jail.
"Today is HISTORY because finally the Constitutional Court has the courage to declare a firm and clear legal edict that parents who take their child by force and outside their authority (not the holder of custody rights) can be punished under Article 330 of the Criminal Code," wrote Tsania Marwa as quoted by brilio.net from the Instagram account @tsaniamarwa54, Monday (30/9).

After going through various struggles, Tsania finally chose to sincerely let Atalarik take care of her two children. Although Atalarik experienced defeat in the Judicial Review or PK which aimed to defend his children.
"If the tears and pain I experienced during the 7 years and 6 months brought me this much wisdom, I accept it. Hopefully, this result can be of help to thousands or more mothers who experience the same thing as me," she wrote.

Continuing in the statement uploaded on Saturday (28/9), Tsania had no intention of reporting her ex-husband who had taken her child by force.
"Would I report the father of my children? The answer is: No," she added.
The 33-year-old woman has her own reasons for not reporting Atalarik. According to her, it was too late because now Tsania has been separated from her children for 7 years and 6 months.
"Why? It's too late! My two children have been separated from me for 7 years and 6 months and of course there is an impact on the children's thinking that has been "formed," said Tsania.

According to Tsania, the child's mental health will be at stake if she reports Atalarik. She added that winning or losing is not the main goal at this time.
"The most important thing is to know when to step back and give in for the sake of the child (not your own ego)," wrote Tsania.
The initial goal of her efforts to take legal action was not only to get her two children, but also to accompany this case to the Constitutional Court to help women who have the same fate.
"I have said from the beginning that my intention to oversee this case at the Constitutional Court is to help mothers who are experiencing what I experienced, because I know what the pain is like," he added.

The struggle to get her children back is over. Tsania is now submitting her struggle through the sky. In addition, Tsania also explained that she is not sad about the actions she is now taking.
"Am I sad? No. Why? Because this article is still very likely to be applied to those who have just been separated from their children and I am very happy, finally there is clear legal certainty for those who have permanent child custody rights," he explained.
