Ari Bias recently responded to his lawsuit against Agnez Mo regarding the unauthorized use of the song "Bilang Saja" at three different concerts. The Central Jakarta Commercial Court has found Agnez Mo guilty and fined her Rp1.5 billion.
In his statement, Ari Bias revealed that many people doubted the outcome of his lawsuit. However, in reality, the court granted all his demands.
"So the decision was indeed a process that I submitted regarding the alleged copyright infringement, many people did not expect the results to be like this," said Ari Bias in the Tendean area, South Jakarta, Wednesday (5/2).
"Many thought it would fail, not succeed, you know. But it turned out the decision granted all my lawsuits," he said.
Ari assessed that the ruling made it a hot topic of conversation, especially among singers. This is because the ruling states that singers are responsible for the songs they sing in performances.
"That's probably what's causing the commotion now, yes, because the decision can be said to be against the current. Because the decision said that the users in the show were singers," he said.
According to Ari, the music industry has so far placed more emphasis on the responsibility of the organizer for the royalties of songs performed by the performers. However, the court ruling states that the singers must be responsible as performers.
"It turns out that the court decision said that the performer was the singer who had to be responsible. The EO only helped take care of the singer's permit," he explained.
Ari also highlighted the view of the Federation of Indonesian Musicians Unions (FESMI), which has always stated that the organizer is responsible for a performance, including the songs performed.
"In my opinion, FESMI said that because that is what has been going on based on custom. But this has become a judge's decision, and the decision has legal force and is based on the law. The mandate of Law Number 28 mandates users in a performance, yes, specifically performances, not others, that is singers," said Ari Bias.
