On November 25, 2024, the South Jakarta Religious Court announced its decision regarding the application for marriage confirmation from a famous couple, Rizky Febian and Mahalini . Unfortunately, their application was rejected because one of the requirements for marriage was not met.
Suryana, Public Relations of the South Jakarta Religious Court, explained that this trial aims to discuss the results of the deliberation based on the evidence presented. "The examination process has been considered sufficient, so today's trial is the result of the panel's deliberation on the examination of evidence in the previous trial," he said.
In further explanation, Suryana stated that the decision was taken because one of the requirements for marriage was not met, namely the guardian who married was not the rightful guardian. This is an important point that is the basis for the rejection of their application for marriage confirmation.
Suryana added that in the trial it was revealed that Rizky and Mahalini were married by a cleric who acted as a judge's guardian. In the Marriage Law, the selection of a judge's guardian is clearly regulated.
"The guardian judge is appointed by the Minister of Religion and delegated to the head of the KUA. That is what is meant by the guardian judge," he explained.
Suryana also explained the criteria for a guardian judge regulated in the Marriage Law. There are two main criteria, namely a guardian of lineage and a guardian judge. Guardians of lineage are those who have kinship ties, while guardian judges are people who do not have a guardian or a guardian whose address is unknown.
"There are also judges who do not want to marry. In this case, there must be a decision from the court," he added.
After considering all the facts, the panel of judges decided to reject Rizky and Mahalini's application for marriage confirmation. The court advised them to remarry in order to obtain a marriage certificate that is valid according to religion and the state.
"Automatically rejected, because one of the pillars is not fulfilled. To get a valid marriage certificate, they need to remarry," concluded Suryana.
