Brilio.net - PT Kereta Api Indonesia (Persero) or KAI has confirmed the prohibition of activities on the railway tracks for the safety of all. Activities on the railway tracks are only permitted for train operational purposes. The statement was made in response to a tragic incident that killed four people after being hit by a train while playing around the railway tracks.

The incident occurred on Sunday, September 22, 2024, at Km 88+700 Hulu Line, between Cikampek Station and Tanjung Rasa Station, Karawang Regency, West Java. Immediately, the video upload of the incident went viral on social media, showing a number of residents relaxing and waving as the train passed. Unfortunately, when the train came from the opposite direction, four people were unable to avoid it, and the incident ended fatally.

Three of the four victims who died were S (65), AA (37), and MA (7), who were hit by the Fajar Utama Solo train that was passing by. Another victim, T (7), was caught in the front of the train and dragged 10 kilometers towards Tanjungrasa Station. This incident shows the importance of obeying the prohibition on activities on railroad tracks to prevent accidents that can claim lives.

If examined further, the rules related to the prohibition of activities along the railway line have been regulated in Law Number 23 of 2007 concerning Railways. But unfortunately, the public is still unfamiliar with the prohibition so that many carry out activities around the railway line.

Examining the applicable regulations, specifically in Law Number 23 of 2007 concerning Railways, the regulations regarding general prohibitions are contained in Chapter XV Articles 178 to 185.

The prohibitions are quite specific, starting from the prohibition on constructing buildings, making places, planting types of trees, placing goods on railway lines to the prohibition on carrying out activities on railway lines.

The prohibition on carrying out activities on railway lines is contained in Article 179 which reads:

"Everyone is prohibited from carrying out activities, either directly or indirectly, that could result in land shifting on the railway line, thereby disrupting or endangering train travel."

This is further emphasized in Article 181 which states that no one should be in the railway line's benefit space or even use the railway line for other purposes, other than for railway transportation. Article 181 paragraph (1) reads, among others:

"Everyone is prohibited from:
a. located in the railway benefit space;
b. drag, move, drop, or
moving goods on rails or across tracks
train; or
c. using the railway line for purposes other than rail transport."

Furthermore, if someone violates the prohibition, especially in Article 179, they can be subject to sanctions as stated in Article 193 paragraph (1) "Any person who carries out activities, either directly or indirectly, which can result in land shifting on the railway line so as to disrupt or endanger train travel as referred to in Article 179, shall be punished with imprisonment for a maximum of 1 (one) year and/or a maximum fine of IDR 250,000,000.00 (two hundred and fifty million rupiah).

It is further emphasized in Article 199 regarding sanctions that if anyone is in the railway benefit space, they can be subject to a prison sentence of 3 months or at least a fine of fifteen million rupiah.

"Any person who is in the railway benefit space, dragging goods on or across the railway track without permission, and using the railway track for purposes other than for railway transport which can disrupt train travel as referred to in Article 181 paragraph (1), shall be punished with imprisonment for a maximum of 3 (three) months or a maximum fine of Rp. 15,000,000.00 (fifteen thousand rupiah).
