What is an Electronic Signature?

An electronic signature is a signature consisting of electronic information that is useful for verifying and authenticating identity. The creation of electronic signatures can be made by various types of applications or generators available both online and offline.

Types of Electronic Signatures

Referring to the eIDAS (electronic identification, authentication, and trust services) regulations, electronic signatures are divided into three types, namely simple, advanced, and qualified.

Simple means the most basic electronic signature without a special encryption method. Next, there is advanced where you can see and identify who the signer is. Finally, qualified is a type of electronic signature that has the strongest legal force and needs to be signed through an authorized provider according to state regulations.

Legal Basis of Electronic Signatures in Indonesia

Electronic signatures were first regulated in Law No. 10 of 2008 (ITE Law) which was later strengthened in PP No. 71 of 2019. In the government regulation, it is stated that electronic signatures have two types, namely:

  1. Certified electronic signature
  2. Electronic signature is not certified

The difference between the two is that a certified electronic signature is made using the services of an Electronic Certification Provider and can be proven with an Electronic Certificate. On the other hand, an uncertified ETC is made without using the services of an electronic certification provider.
